Terms of Service

1. Acceptance of terms

By using aiworkflow.design, engaging AI Workflow Design (“we”, “our”, “us”) for services, or installing or using one of our products, including Autoza AI for monday.com, the AI Receptionist, and the Daily Check-in Agent (together, the “Services”), you agree to these Terms of Service. If you do not agree, do not use the Services. Where you have signed a separate statement of work or order form, that document governs to the extent it conflicts with these Terms.

2. Description of services

• Products: ready-made AI agents offered at a published monthly price, such as automated start-of-day and status calls logged to monday.com, inbound call answering and appointment booking, and scheduled check-in calls to staff.
• Custom development: design and build of voice or workflow agents to a written specification, quoted as a fixed fee.
• Retainers: ongoing hosting, monitoring, tuning, and support for agents we have built, billed monthly.

3. Accounts, trials, and bring-your-own-key

Free trials

• Trial allowances (for example 100 outbound calls in Autoza AI) are provided at no cost, on our shared telephony account and shared calling number.
• Trial calls are counted per attempted call, including retries. When the allowance is used, automated calls pause and your data is preserved.
• We may suspend trials used for spam, harassment, telemarketing, or other abuse without notice.

Bring your own key

• Where you connect your own telephony or AI provider account, that provider bills you directly and you are responsible for keeping it funded.
• We store your keys encrypted at rest and you may rotate them at any time.

4. Requirements and your responsibilities

• You must have authority to connect the systems and phone numbers you configure.
• You must obtain any consent required before automated calls are placed to, or recorded from, any person, and comply with the TCPA, state call-recording laws, GDPR, CAN-SPAM, and any other applicable rules.
• You must keep your account credentials secure and tell us promptly if you believe they are compromised.
• You must provide accurate information during onboarding and keep notification contacts current.
• You may use the Services only for legitimate business communication.

5. Acceptable use

You agree not to use the Services to: place telemarketing, political, debt-collection, or unsolicited commercial calls; harass, threaten, or impersonate anyone; violate any law or third-party right; access non-public parts of the Services; interfere with the Services or connected networks; reverse engineer the Services or underlying models; or resell the Services outside your organisation without our written consent.

6. Fees and payment

• Product subscriptions are billed monthly in advance at the price published when you subscribe, or via the marketplace you installed from (for example monday.com).
• Custom builds are billed as set out in the quote, typically 50% on signing and 50% on go-live.
• Retainers are billed monthly in advance and may be cancelled with 30 days’ notice.
• Telephony, AI-provider, and third-party SaaS usage charges are passed through or billed to you directly by the provider.
• Late payments may result in suspension after 14 days’ notice.

7. Service availability

We aim for high availability but do not guarantee uninterrupted or error-free service. The Services depend on third parties (telephony carriers, AI providers, monday.com, Google, and the systems you connect) outside our control. We may modify or discontinue features with reasonable notice where changes materially affect existing clients.

8. Data and privacy

Your use of the Services is also governed by our Privacy Policy, including its sections on free trials and shared infrastructure. You retain all rights to your data; we claim no ownership of your board content, recordings, transcripts, or other content you provide.

9. Intellectual property

The Services, including designs, source code, prompts, and documentation, are owned by AI Workflow Design and its licensors. For subscription products you receive a limited, non-exclusive, non-transferable licence for the term of your subscription. For custom builds, ownership of deliverables is as stated in the statement of work; unless it says otherwise, you receive a perpetual licence to the delivered agent configuration and we retain ownership of our underlying tooling and libraries.

10. Warranties and limitation of liability

The Services are provided “as is” and “as available” without warranty of any kind. AI agents can make mistakes, including mis-transcription, mis-routing, missed calls, and incorrect updates; you are responsible for reviewing outputs where accuracy matters. To the fullest extent permitted by law we are not liable for indirect, incidental, special, or consequential damages, or for business losses arising from the Services. Our total liability under these Terms is limited to the fees you paid us in the 12 months before the claim. For trial users who have paid us nothing, our total liability is USD $0.

11. Termination

• By you: cancel a subscription at any time from your account or marketplace, uninstall the app, or give 30 days’ notice on a retainer. Tenant data is deleted within 10 days of termination.
• By us: we may suspend or terminate access for breach of these Terms, abuse of a trial, or non-payment, with notice where reasonably possible.

12. Governing law

These Terms are governed by the laws of the United States and the state in which AI Workflow Design is registered, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that state unless the parties agree otherwise in writing.

13. Changes to terms

We may update these Terms from time to time. Material changes will be announced on this page and, for active clients, by email. Continued use after changes take effect constitutes acceptance.
